Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FieldFlash PRO platform and services ("Service") provided by Jeffrey Allen Christen doing business as FieldFlash PRO ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

FieldFlash PRO is a cloud-based field service management platform designed for generator maintenance and service companies. The Service includes tools for customer management, work order management, scheduling and dispatch, invoicing, inventory tracking, equipment records, service agreements, and customer communication via email and SMS.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• You must be at least 18 years old to use the Service.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to send unsolicited or unauthorized messages (spam)
• Violate any applicable laws, including telecommunications regulations (TCPA, CAN-SPAM)
• Attempt to gain unauthorized access to the Service or its systems
• Upload or transmit malicious code, viruses, or harmful content
• Use the Service to collect, store, or process data in violation of privacy laws
• Reverse-engineer, decompile, or disassemble the Service

4. SMS Messaging Compliance

If you use the SMS notification features of FieldFlash PRO, you agree to:

• Obtain proper consent from all recipients before sending SMS messages, as outlined in our SMS Consent Policy
• Include opt-out instructions in all messages
• Honor opt-out requests immediately
• Only send transactional messages related to active service appointments and account activity
• Comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA)
• Not use the SMS features for marketing, promotional, or unsolicited messaging

5. Data Ownership

• Your Data: You retain all rights to the data you input into the Service. We do not claim ownership of your customer data, work orders, invoices, or other business records.
• License: You grant us a limited license to use your data solely to provide and improve the Service.
• Export: You may export your data at any time through the Service's export features or by contacting us.

6. Third-Party Services

The Service integrates with third-party services including QuickBooks Online, Twilio, Mailgun, Stripe, Helcim, and Google Maps. Your use of these integrations is subject to the respective third party's terms of service. We are not responsible for the availability, accuracy, or practices of third-party services.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance and will endeavor to provide advance notice when possible. We are not liable for any downtime, interruptions, or data loss.

8. Payment Terms

Subscription fees, if applicable, are billed on the schedule agreed upon at sign-up. All fees are non-refundable unless otherwise stated. We reserve the right to modify pricing with 30 days' written notice.

9. Termination

• You may cancel your account at any time by contacting us.
• We may suspend or terminate your account if you violate these Terms.
• Upon termination, you may request export of your data within 30 days.
• After 30 days, we may delete your data from our servers.

10. Limitation of Liability

To the maximum extent permitted by law, FieldFlash PRO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless FieldFlash PRO from any claims, losses, or damages (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitute acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the courts of the state where FieldFlash PRO operates.
